Terms and Conditions
These Terms and Conditions ("Terms") govern your use of nightfallpresents.com and the Nightfall Presents text message program, operated by Nightfall Presents LLC ("Nightfall Presents," "we," "us"). By using the site or joining the text program, you agree to these Terms.
Text message program
- Program: Nightfall Presents text alerts. When you opt in at nightfallpresents.com/text-signup and check the consent box, you agree to receive recurring text messages from Nightfall Presents about event announcements, presales and ticket alerts.
- Frequency: message frequency varies.
- Cost: message and data rates may apply. Check your mobile plan for details.
- Opt out: reply STOP to any message to stop receiving texts. You'll receive one final message confirming you've been unsubscribed. To rejoin, sign up again on our website.
- Help: reply HELP for help, or email jake@nightfallpresents.com.
- Consent: consent to receive text messages is not a condition of any purchase.
- Eligibility: you must be the account holder or have the account holder's permission to enroll the mobile number.
- Carriers: mobile carriers are not liable for delayed or undelivered messages.
- Privacy: we do not share mobile numbers or SMS opt-in information with third parties for marketing purposes. See our Privacy Policy.
Tickets
Tickets to Nightfall Presents events are sold through Posh and are subject to Posh's terms as well as these Terms. Tickets are non-refundable unless an event is cancelled. Buy tickets only through official Nightfall Presents links; we are not responsible for tickets bought from resellers.
Event entry
Events have age requirements, a bag policy, a prohibited items list and a dress code, posted on our FAQ page and event pages. Entry is at the discretion of Nightfall Presents, venue management and security, who may refuse entry or remove anyone for safety, conduct, intoxication or policy violations without a refund. Events may be photographed or filmed; by attending you agree that your likeness may appear in event media.
Using our website
Content on this site, including logos, artwork, photos and text, belongs to Nightfall Presents or its partners and may not be copied or used without permission. Do not misuse the site, attempt to access it without authorization or interfere with how it works.
Disclaimers and limitation of liability
The site and text program are provided "as is." To the fullest extent allowed by law, Nightfall Presents is not liable for indirect, incidental or consequential damages arising from your use of the site, the text program or attendance at events. Lineups, times and venues can change.
Changes
We may update these Terms. The effective date above shows when they were last changed. Continued use of the site or text program means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Ohio.
